My situation is that our house was built in 2005 (prior to AFCI being required in certain locations). The inspection report claimed that the lack of them is “Deficient” since there inspection states that they have to inspect the house as if it were built the day before.

The potential buyer is now worried that this is a requirement and asking us to upgrade…which will be quite expensive. More so, he is military personal and is claiming that his insurance company (USAA) requires them to have them in order to be insured.

We keep on telling him that we are grandfathered in since our house was built prior to February 2009 (when the code was implemented) but he is having dificulty understanding this. He is also claiming that because the house is changing owners, the house must be brought up to code.

We will definately follow-up with the code and insurance companies but I wanted to see if anyway has insight on this sort of situation.
